The relevant defendant may file a counter-appeal with the court hearing the appeal and within thirty-five days from the date of learning of the unilateral decision by the lower court against him or her without completing the procedure in accordance with this paragraph. .
(2) If an appeal is received in accordance with sub-section (1), the court hearing the appeal shall, before hearing the appeal, determine whether or not the time limit has been met for the person who has been made a respondent in the petition or who has been appointed by the court as a respondent in accordance with section 123.
(3) During the hearing according to sub-section (2), if it is determined by the court hearing the appeal that the defendant or the person who has been appointed as a defendant by the court in accordance with section 123 has not served the time limit properly, the unilateral decision made by the lower court in such case shall be overturned and the counter-letter shall be maintained to the appeal and the case shall be re-processed and the hearing shall be closed in accordance with the law. After ordering the lower court, the case file should be sent to that court.
(4) If a letter containing an order is received from the court hearing the appeal in accordance with sub-section (3), within three days of receipt of such letter, the relevant court shall issue the order in the name of the defendant within a period of seven days, excluding the time limit for travel.
(5) If the time limit has expired according to sub-section (4), if the defendant appears within the time limit or after the time limit has expired, the case shall be processed, heard and disposed of in accordance with the law.
